Honorable Kelly Fitzgerald Pate

Judge Kelly Fitzgerald Pate was sworn in as a Magistrate Judge for the Middle District of Alabama on September 8, 2020.

After completing her undergraduate studies at The University of Alabama, Judge Pate graduated law school, with the magna cum laude distinction, from Cumberland School of Law. She was Symposium Editor of the Cumberland Law Review and served in leadership roles in other organizations throughout her law school tenure. 

Before beginning the practice of law, Judge Pate clerked for the Honorable Joel F. Dubina on the Eleventh Circuit Court of Appeals. She followed her clerkship with a civil litigation practice. During her more than 15 years in practice, Judge Pate was also involved in bar and civic engagements in the community, including serving as Director of the Middle District of Alabama Pro Se Assistance Program and completing the Alabama State Bar Leadership Forum.
